Status of  Recent Zoning Appeals

There is currently no new activity to report. Current status— Based on the Town of Smithtown’s Department of Environment & Waterways recommendation, a SEQRA positive declaration has been adopted.  A positive declaration indicates that the variances requested may have a significant adverse effect on the environment. It is our concern that the low water table and serious drainage issues at the site will negatively affect the local area, including the fresh water preserve just across the road. Further, the proposed expansion is out of character with our area and would be more aptly sited in a commercially zoned business district such as Jericho Turnpike or Route 347 and not in a “neighborhood business” district as this site is currently zoned.

 At this time the BZA can deny, but cannot approve any variance applications until the SEQRA process is completed. The SEQRA process includes the preparation of a draft environmental impact statement as well as a final environmental impact statement which details all the findings.  

 18 Josephine Lane

Smithtown Town Council voted to appeal the September 19, 2007 State Supreme Court decision allowing the owners of 18 Josephine Lane to continue operating an animal hospice on their property.
